To that end, we have created this privacy statement to inform you about our information gathering and dissemination practices for this Site, www.klir.com, related sub-domains (collectively, the "Site"), and the Solutions (as defined in the Terms of Use) (together with the Site, the "Services"). In this privacy statement you will find information regarding the following: 1. What personally identifiable information we collect through the Services and how that information is used. We will only share your information with third parties as described in this privacy statement or if we are required to do so by law or in the good-faith belief that such action is necessary in order to conform to the edicts of the law, cooperate with law enforcement agencies, or comply with legal process. What Personally Identifiable Information do We Collect and How is it Used? Sign-On. In order to use this Site, you must first complete the registration form. During registration you are required to provide your name and email address. This information is to allow you to access and participate in the interactive areas of the Site and enable us to communicate with you regarding the Services as well as other products, services and opportunities we believe will be of interest to you. We will also use this information to send you a monthly newsletter that includes information about our services, and Authorized Solutions Providers (as defined in the Site Terms of Use) products and/or services. The newsletter included an opt out provision if you wish to unsubscribe from the newsletter at any time. You are also required to provide demographic information about your company (such as revenue and industry). We use this information to provide you a more personalized experience on the Site. Orders. If you purchase a product or service from us, we request certain personally identifiable information from you on our order form. You must provide contact information (such as name, email, and shipping address) and financial information (such as credit card number, expiration date). We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you. Contact Us. We use links located in the Services to allow you to contact us directly with any questions or comments you may have. This information is used to respond directly to your questions or comments. We may also file your comments to improve the Services and offerings, or review and discard the information. Opt-in Programs. If you have indicated that you are interested in learning more about Klir and our offerings or if you have elected to receive our newsletter or other email publications, we will collect contact information such as name, email address, phone number and address. This information will only be used to contact you to provide you with further information about our products and services as you have requested. Solutions; Institutional Demographic Information. We automatically track certain information through your use of the Services including information about your IT assets (e.g., networks, servers and applications). In addition, if you have signed up for the Solutions, we use the non-personally identifiable information collected through your use of the Solutions as described in the EULA or applicable agreement between you and Klir or you and the Authorized Solution Partner. We use this information to do research on our users' IT demographics, to better understand and enhance our services (e.g., provide better and more accurate baseline and trending data). We may also use this information in aggregate form to help us improve our products and services and engage in related research activities. If you have signed up for Klir Solutions through an Authorized Solution Provider we may also provide this information to that Authorized Solutions Provider to enable them to provide better services to you as well. Their use of this information is subject to your agreement with such Authorized Solution Provider and to such Authorized Solutions Provider's privacy policies. Interactive Areas of the Site. If you choose to post messages in our bulletin boards, chat rooms or other message areas or leave feedback for other users, we will collect that information. We retain this information as necessary to resolve disputes, provide customer support, improve our products and troubleshoot problems as permitted by law. If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on our Site, we may collect such information into a file specific to you. Please note that any personally identifiable information you submit in a bulletin board, chat room or other message area can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. Klir is not responsible for the personally identifiable information you choose to submit in these forums. Klir reserves the right to terminate the accounts of any users of such areas in a manner inconsistent with the Site Terms of Use. Surveys. From time-to-time we may provide you the opportunity to participate in surveys on our Site. If you participate, we will request certain personally identifiable information from you. Participation in these surveys is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and shipping address), and demographic information (such as zip code). Collection by Third Parties. You will be notified when your personal information is collected by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share your information with that party. We use an outside credit card processing company to bill you for services. These companies do not retain, share, store or use personally identifiable information for any other purposes. We may use other third parties to provide Tier 1 and Tier 2 support to certain Accounts. When you sign up for these services, we will share your Contact and Account information as necessary for the third party to provide that service. These third parties are prohibited from using your personally identifiable information for any other purpose. We use other third parties to provide information and targeted content to you that may be relevant to your activities on our Site. Information providers include vendors, analysts, bulletin boards, trade journals, publishers and other content providers that may offer valuable information to help you better leverage our product capabilities. When you access such information, you may be asked by the information provider to provide personally identifiable information. At the time such request is made, you will have the opportunity to decline the request to provide your personally identifiable information to the information provider. We may offer opt in programs for third party information providers, permitting personally identifiable information, such as name, email address, phone number, address, company and demographic information, to be passed to a third party, in exchange for access and retrieval of third party information. Third party use of your personally identifiably information shall be governed by their respective privacy policies, and may be used to contact you to provide you with further information about other products and services. In the event we offer a third party opt in program, then an opt out provision shall be made available to you within your user configuration inside the Services to unsubscribe at any time. Klir is the sole owner of the information collected on Klir.com. Klir collects personally identifiable information about our users at several different points on our Site, as described above. In some instances, and subject to this Privacy Statement, Klir will license, transfer and/or sell such data to Authorized Solutions Providers. Log FilesAs is true of most Web sites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users' movements around the site and to gather demographic information about our user base as a whole. We do link this automatically-collected data to personally identifiable information. IP addresses are tied to personally identifiable information to monitor and identify potential misuse of the Services. We use third-party tracking services from WebSideStory and Google that use cookies to track non-personally identifiable information about visitors to our site in the aggregate of usage and volume statistics to improve the navigation, usability and delivery of our Services. CookiesA cookie is a small text file that is stored on a user's computer for record-keeping purposes. We use cookies on this Site. We do link the information we store in cookies to any personally identifiable information you submit while on our site for security authentication. We use both session ID cookies and/or persistent cookies. We use session cookies to make it easier for you to navigate our site. A session ID cookie expires when you close you browser. We share aggregated demographic information about our user base with our Authorized Solutions Partners, advertisers, and publish such aggregated content to the public marketplace to identify broad trends and utilization statistics. This information does not identify individual users. We do not link aggregate user data with personally identifiable information. Choices Regarding the Use of Your InformationOpt-out. We provide you the opportunity to ‘opt-out' of having your personally identifiable information used for certain purposes, when we ask for this information. For example, if you purchase a product/service but do not wish to receive any additional marketing material from us, you can indicate your preference on our order form. If you no longer wish to receive our newsletter and promotional communications, you may opt-out of receiving them by following the instructions included in each newsletter or communication or by emailing us at support@klir.com. We also offer an opportunity to opt-out of certain communications on our members forum, or you may contact us at the address set forth above to opt-out. You will be notified when your personal information is collected by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share your information with that party. How to Access and Update User Information. If your personally identifiable information changes, or if you no longer desire our Service, you may correct, update, delete or deactivate it by making the change in the user configuration page or by emailing our Customer Support at support@klir.com or by contacting us by telephone or postal mail at the contact information set forth above. How do we Protect the Security of Your Information? Protecting your privacy and your information is a top priority at Klir. We have taken careful measures to help prevent the loss, misuse, and alteration of your information. Once we receive your information that was entered into our Services, it is stored behind a firewall. All Klir employees and service providers are aware of our privacy and security policies. When you enter sensitive information (such as credit card number and/or social security number) on our registration or order forms, we encrypt that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.
